Re: Court Proceedings in Las Vegas
Dear Client(s):
As you may know, yesterday Nevada Governor Steve Sisolak made a public announcement regarding the closure of all non-essential businesses by noon today. As a result, Nevada courts are following suit with many other locations within the United States and suspending eviction proceedings.
After speaking with the courts, the following guidelines have been clarified:
Henderson Justice Court:
- We cannot file any evictions
- Landlords may proceed with posting notices as usual
- Current hearings will be rescheduled
- The Constable will not perform any lock-outs
Las Vegas Justice Court:
- We may still file evictions, but the Court will not set any eviction hearings
- Landlords may proceed with posting all notices as usual
- Current hearings will be rescheduled
- The Constable will not perform any lock-outs
North Las Vegas Justice Court:
- We cannot file any evictions
- No lockout orders will be forwarded to the constable
- The Constable will not perform any lock-outs
Pursuant to the guidance received from the court, we will be proceeding with filing evictions in the Las Vegas Township and recommend to all clients that the continue to process evictions in this jurisdiction at this time. Please note, the constable will not be serving the lock out order for the next thirty (30) days. We expect that the court will continue to work with us with the lock out orders and, following the expiration of the thirty (30) day halt, the constable will execute the lock out orders as directed by the court. As more information comes to our attention regarding this process we will communicate it to you.
In addition, we would like to offer guidance regarding leasing office operations. Leasing offices and all common areas should be closed to the public per the Governor’s Order. However, maintenance and certain functions of the leasing office are essential to tenants, so the leasing office should resume operations with no more than 10 people working in the office at any given time. We would recommend not giving any tours at this time as well.
Please reach out to our office if you have any additional questions.
Regards,
Nicholas J. Klein, Esq.
