COVID-19 - NON-PAYMENT CASES REQUIRE 6 MONTHS OF TENANT LEDGER
Pursuant to local rule change that took effect January 1, 2020, landlords are required to provide a ledger going back at least 6 months in support of their eviction filing. We have been in receipt of ledgers, however, some of them are not going back as far as 6 months. We have seen judges start to push back in an effort not to evict people and indicate that they will not grant judgments where the landlord did not provide the requisite 6 month ledger. Where the tenant has been in the premises for at least the past 6 months, we respectfully request that a ledger going back at least 6 months be included in the eviction request. Any file that does not have a ledger that goes back at least 6 months (provided the tenant has lived in the unit for at least 6 months) may be denied by the court.
