IMPORTANT LEGAL UPDATE for Coronavirus Disease 2019 (COVID-19)
By: Christopher R. Walker
All clients should be assured that the Firm will remain operational during the COVID-19 pandemic. The Firm will continue to serve the multi-family industry and provide legal guidance to assist all clients through this difficult times. Clients are encouraged to call or email our office with any and all questions.
Below are some key facts that all clients should be aware of:
1. Eviction filings have NOT been suspended. Clients, with the exception of
CITY OF PHOENIX OWNED PROPERTIES AND CERTAIN SINGLE FAMILY HOMES WITH FHA INSURED MORTGATES, are PERMITTED to continue eviction filings.
2. Courts in Maricopa, Pinal, and Pima counties have put in place certain modifications to court schedules. A full list of current court changes is available on our website at
clarkwalker.com/COVID-19-3.asp
3. The Firm will continue to work with Justice Court Administration to create a streamlined and safe process to allow for the timely filing and adjudication of all eviction hearings.
4. Some courts and some constables are delaying the execution of writs of restitution. We are trying to get an established practice to ensure writs are timely executed and served county-wide.
Any person who has questions about a proper protocol or who needs additional assistance is strongly encouraged to contact legal counsel at any time.
